, we go to caroline ross. i like the name, it's good. congratulations. thank you very much. >> you talked about that ubs story. that's a massive, massive fine. one of the biggest banks here in europe. yes, there have been a lot of press speculation about the side of the fine, but it's three times bigger than the fine ba barclay's was fined. ubs also admitting to criminal wro wrongdoing in japan. >> how are global markets doing at this hour? >> well, actually global markets are up. they're cheering, you know, the fact that there could be a fiscal cliff deal between democrats and republicans. look, we've got european markets close to year highs, the cac and dax at 52-week highs. this is more related to the expected aggressive monetary easing by the boj, but even the u.s. markets, the s&p 500 at a two-month high. >> i'm curious, we never really know how the fiscal cliff conversation plays out overseas. is it something that moves the needle in the markets in europe and asia? >> absolutely it does. given that, you know, in terms of european risk, everything pretty much done and dusted.
. >> reporter: but closure for the families of deborah ross and ersie everette known as chuck will have to wait. the judge has reaskedded the official sentence -- rescheduled the official sentencing of the killer nathan burris until january 18. they were gunned down at the richmond/san rafael tollbooth in 2009. burris was ross' ex-boyfriend the sentencing was supposed to happen today after a jury handed down the death penalty back in november. family members were prepared to read victim impact statements but instead, it was burris and his advisory counsel who spoke asking for a new date. burris represents himself and says the sheriff's department revoked his pro per leaving him without access to a library or any way to research and prepare. >> to me, it's a joke now. he's a joke. you know? he is trying to do anything he can to stay in the county jail. >> we are used to his antics now, you know, we kind of expect something he is going to do something. you kind of roll with the punches. but the main thing is that we know this is coming to an end. we know that we're going to be able to move on. >

" begins right now. >>> good morning, everyone. welcome to "squawk box" on nbc is. andrew ross sorkin is out today. we hope he's feeling better soon. >>> as we've been talk being the fiscal cliff this week, president obama and speaker boehner appear to be inching toward a deal. last night republicans announced plan b in case talks fail. they'll be moving to pass their own tax bill as a backup plan to avert the tax hikes. and the automatic budget cuts set to happen next month. it would extend low tax rates except on those with incomes of $1 million and above. president obama's latest position puts that threshold at $400,000. >> at this point, having a backup plan to make sure that as few american taxpayers are affected by this increase as possible. >> now no one expects that the gop bill will pass the democratic-controlled senate. in fact, harry reid said forget it, they're not going to be passing any of these things. but this is another option out this. and it does change the dynamics in terms of who's going to be blamed for raising taxes. we'll see how this plays out. >>> among our g
